These Terms and Conditions govern your access to and use of www.watersygroup.com and related Watersy websites, subdomains, and pages (the “Site”). By accessing the Site, you agree to these Terms. If you do not agree, please stop using the Site.
1. Who we are
Watersy is a drinkware OEM/ODM manufacturer serving global brands, retailers, distributors, e-commerce sellers, and promotional-gift buyers. In these Terms, “Watersy”, “we”, “us”, and “our” refer to the following company:
Zhejiang Shuixi Industry & Trading Co., Ltd.
No. 46, Mudan South Road, Baiyang Street
Wuyi County, Jinhua City, Zhejiang Province, China
Email: market@watersycup.com
Phone / WhatsApp: +86 186 7920 7029
2. Scope of the Site
The Site provides general information about Watersy’s manufacturing capabilities, product categories, customization options, certifications, and business-contact channels. The Site is intended for business users interested in OEM/ODM drinkware projects, wholesale distribution, retail programs, or promotional-gift sourcing. It is not a consumer checkout system.
These Terms do not replace a quotation, proforma invoice, sales contract, purchase order, non-disclosure agreement, tooling agreement, or other written commercial agreement. If another written agreement conflicts with these Terms for a specific transaction, that written agreement prevails.
3. Product and website information
Product images, specifications, capacities, colors, decoration options, lead times, minimum order quantities, certificate references, and other information on the Site are indicative only. They may change because of product development, material availability, testing standards, factory scheduling, destination requirements, or normal production variation.
No content on the Site is a binding offer, warranty, stock commitment, or price confirmation. A binding obligation arises only when Watersy and the buyer expressly agree in a signed or otherwise confirmed commercial document.
4. Inquiries and quotations
You may ask for a quotation, sample, customization proposal, or project discussion through the Site, email, WhatsApp, or telephone. To process a request, Watersy may ask for details such as product category, quantity, target market, customization method, artwork, timeline, packaging preference, and compliance requirements.
A quotation may depend on:
- product configuration and decoration method;
- order quantity and production schedule;
- raw-material and packaging selections;
- testing, certification, or market-compliance requirements;
- shipping terms, destination, and logistics conditions;
- payment terms and commercial risk assessment;
- legal, customs, or export-control restrictions.
Quotations are valid only for the period stated in the quotation. If no period is stated, Watersy may update or withdraw the quotation before acceptance.
5. Samples and artwork
Samples may be provided for design, structure, surface, insulation, or decoration evaluation. Sample terms are confirmed separately. Unless expressly agreed in writing, a sample does not create an obligation for mass production.
If you provide artwork, trademarks, product images, drawings, or files, you confirm that you own the required rights or hold a valid licence and that their use does not infringe third-party rights. Watersy may refuse artwork that is unlawful, misleading, offensive, or likely to create legal risk.
6. Orders, payment, and delivery
Online forms, product lists, and buttons on the Site are not a checkout and do not automatically accept payment or create an order. Orders are negotiated and confirmed separately. Payment method, deposit, balance, currency, bank charges, taxes, duties, Incoterms, and related conditions are governed by the confirmed commercial documents.
Delivery schedules are agreed in the relevant quotation or order confirmation. Actual delivery may be affected by approval speed, order volume, raw-material availability, factory scheduling, logistics conditions, customs clearance, or other factors beyond the Site’s description. Watersy is not liable for delays caused by events beyond its reasonable control unless otherwise agreed in a binding contract.
7. Quality and compliance
Watersy maintains quality-management systems and may support testing, certification, and compliance documentation according to the requirements of a specific project. Testing methods, standards, certificates, and product-market approvals must be confirmed in the quotation or order confirmation.
Requirements that are not confirmed in writing are not part of the product specification.
8. Intellectual property
All Site content, including text, layout, design, graphics, images, icons, video, code, product renders, and branding, is owned by Watersy or its licensors. The Watersy name and related names, logos, and visual elements may be protected by trademark and other laws.
You may not copy, modify, publish, sell, rent, or distribute Site content without prior written permission. Limited quotation or linking is permitted where it does not create confusion about endorsement or misrepresent Watersy’s business.
9. Acceptable use
You agree not to:
- use the Site unlawfully or for fraudulent purposes;
- submit false, misleading, or unauthorised information;
- upload malicious code or interfere with the Site’s operation;
- attempt to gain unauthorised access to systems or data;
- scrape or harvest content contrary to applicable law or reasonable website use;
- impersonate another person or company;
- use automated tools to overload forms, search functions, or hosting infrastructure.
Watersy may restrict access and preserve evidence where misuse occurs.
10. Third-party content and links
The Site may link to social media pages, marketplaces, certification databases, logistics tools, or other third-party resources. Those resources are controlled by other parties. Watersy does not control and is not responsible for their content, security, availability, products, or practices.
11. Disclaimers
The Site is provided for general business information. To the maximum extent permitted by law, Watersy disclaims all implied warranties arising from use of the Site, including warranties of uninterrupted availability, error-free operation, merchantability, fitness for a particular purpose, and non-infringement relating to Site content.
Nothing in these Terms limits any warranty or remedy expressly agreed in a signed sales contract or required by mandatory law.
12. Limitation of liability
To the maximum extent permitted by law, Watersy is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from use of the Site. Where liability cannot be limited by law, Watersy’s total liability connected with the Site is limited to the amount directly attributable to the relevant transaction or, if no transaction exists, to a reasonable amount under the circumstances.
This limitation does not apply to liability that cannot legally be limited.
13. Indemnity
You agree to indemnify Watersy against claims, losses, and reasonable costs arising from your misuse of the Site, your infringement of third-party rights, or material you submit through the Site.
14. Export and import compliance
You are responsible for confirming that any product, transaction, or end use complies with applicable export-control, import, customs, sanctions, and product-compliance rules in the relevant countries. Watersy may decline requests that cannot be lawfully fulfilled.
15. Communications
By contacting Watersy through the Site, you consent to receive business communications reasonably related to your inquiry. Marketing messages are sent only where permitted by law or where you have subscribed. You may ask Watersy to stop marketing messages at any time.
16. Changes to these Terms
Watersy may update these Terms from time to time. The “Last updated” date shows when the current version was published. Continued use of the Site after changes are published means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-laws rules. Disputes should first be resolved through good-faith negotiation. If negotiation does not resolve the dispute within 30 days after written notice, the dispute shall be submitted to a court of competent jurisdiction in Jinhua, Zhejiang Province, China, unless the parties agree otherwise in writing. Nothing in this clause prevents either party from seeking urgent injunctive relief where permitted by law.
