FDA Compliance

IN DEPTH

Also: FDA food-contact compliance, 21 CFR compliance

FDA compliance means a product's food-contact materials meet US FDA limits under 21 CFR 170–199, shown by a lab test report rather than a certificate.

In the United States, the FDA regulates food-contact materials under 21 CFR 170–199. These rules set out which substances may touch food and how much of a substance may migrate into it. For drinkware, FDA compliant means the materials in the bottle, lid, gasket, and any plastic liner fit within those rules. It is not a certificate a product owns, and there is no FDA approval logo a factory can legally print on packaging.

What the claim actually means

When a factory says a product is FDA compliant, it is stating that the raw materials are cleared food-contact grades used within the FDA’s limits. The typical combination in stainless drinkware is 18/8 stainless steel, polypropylene, Tritan, and food-grade silicone. Stainless drinkware reports typically reference the sections covering metals, polymers, and elastomers, and the report should reflect each component’s applicable section. The claim is only as good as the documentation behind it.

Reading the report

A lab tests the materials against the relevant FDA limits and issues a report that names the material, the standard or CFR section, the test conditions, and the result. Check three things: the report covers your exact SKU, it lists every food-contact component, and it is current for the production version you are ordering.

Myth vs factAn FDA compliant label is an official government approval — there is no FDA approval certificate for finished drinkware, only materials that meet the rules and lab reports documenting the tests.

A comparison of the wording you will see:

Wording What it means What to request
FDA compliant materials Materials fall within FDA limits FDA test report per material
FDA approved product Misleading shorthand The underlying lab report
FDA registered facility Factory registration, not product approval Registration number plus product report

Practical takeaway: Ask for the lab test report covering your exact SKU and every food-contact material rather than accepting an FDA compliance claim at face value.
